Terms and conditions
Conditions of Use for the Cambridge Judge Business School alumni website and its subdomain (‘the University’s site’) at www.cjbs.net
Thank you for visiting our site. Please read these conditions carefully before using the site. They apply to all users of and visitors to the site (‘you’). In consideration of being allowed to use the site and by proceeding to use the site you signify that you agree to be bound by the following conditions (and documents referred to in them), as revised by us from time to time. Revised conditions take effect when published.
Information about us
The site belongs to the University of Cambridge of The Old Schools, Trinity Lane, Cambridge, United Kingdom CB2 1TN (“the University”).
The site is operated by our supplier Aluminati Network Group Ltd of 2 Minton Enterprise Park, Oaks Drive, Newmarket, CB8 7YY. With regards to data, Aluminati formally operate as our Data Processor (“Aluminati”).
‘We’ or ‘us’ means the University and Aluminati.
Information about you and your visits to our site
We process information about you in accordance with our privacy policy which forms part of these conditions and in accordance with the CJBS Data Protection Statement, and the Aluminati Data Protection Statement. By using our site, you consent to such processing and warrant that all data you provide is true and accurate.
Accessing our site
Your user password and any other piece of information provided as part of our security procedures is confidential. You must not disclose it to any third party.
You are responsible for making all arrangements necessary for you to have access to the site. You are also responsible for ensuring that all persons who access the site through your internet connection are aware of these conditions and comply with them. Access to the site is always at the University’s discretion and the University may withdraw or amend the services provided on the site without notice. From time to time the University may restrict access to some or all users to some or all parts of the site and sometimes the site may be unavailable. You use the site and the internet in general at your own risk. We use reasonable efforts to ensure the continuous operation and availability of the site we and we use technologies to keep users' data safe and accurate but we cannot and do not guarantee these things. Where possible we will post advance notice on the site where downtime is scheduled for maintenance. As is normal, you note the need to maintain backup copies of any important data..Whilst the University aims to update its site regularly the content on ther site may be out of date at any given time.
If the University determines that you have breached any of these conditions, it may take such action as it deems appropriate, including disabling your password whether chosen by you or allocated by us. You agree to indemnify us for all claims brought by a third party against us arising out of or in connection with any breach by you of any warranty set out in the conditions.
Uploading material to our site
Whenever you make use of a feature that allows you to upload material to the University’s site, or to make contact with other users of the site, you must comply with our acceptable use policy which forms part of these conditions. You warrant that any such contribution complies with that policy.
We shall respectively have the right to copy and use any material you upload for the purposes set out in our respective data protection statements and privacy policy and you grant a non-exclusive licence royalty free for such purposes. If we choose to use any material you upload, we will try to contact you first. The University may view but does not actively monitor all material uploaded. Other users have the right to view but not copy material you upload to pages which are accessible by them.
We may disclose your identity if required by law or if requested by any third party who claims that any material posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy
We do not assume responsibility or liability for the content or accuracy of any materials posted by you (or any other user of our site). We may remove any material or posting you make on our site if, in our opinion, such material does not comply with the University’s acceptable use policy.
Aluminati will report all complaints and breaches of which it is aware to the University and will act as instructed by the University in relation to University data.
Intellectual property rights
The University is the owner or the licensee of all intellectual property rights in the site and in the material published on it, except to the extent material is collected and published by Aluminati for purposes set out in its data protection statement. Contributions or material submitted by University of Cambridge staff and students (and others as prescribed) are also subject to the Statutes and Ordinances of the University of Cambridge, specifically Ordinances, Chapter XIII Finance and Property, Intellectual Property Rights http://www.admin.cam.ac.uk/univ/so/. All University material is protected by copyright laws and treaties around the world. All such rights are reserved. You must acknowledge the University and that of any identified contributors as the authors of such material. Nothing contained in the site shall be taken, construed or considered as a grant of licence or right to use the trademarks of the University of Cambridge or that of any third party displayed on the site without the prior written permission of the respective owner/s. Subject to statutory allowances, extracts of material from our site may be accessed, downloaded and printed for your personal and non-commercial use and you may draw the attention of others within your organisation to material posted on the site.
You may not modify the paper or digital copies of any material printed off or downloaded in any way and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. You must not use any part of the material on the site for direct or indirect commercial purposes or advantage without obtaining a licence from us or our licensors.
If you print, copy or download any part of the site in breach of these conditions, your right to use the site will cease immediately and you must at our option return or destroy any copies of material made.
Linking to our site
You may link to our respective home pages (namely Cambridge Judge Business School alumni website and Aluminati’s business home page), provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any website that is not owned by you. Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page. We reserve the right to withdraw linking permission without notice. The website from which you are linking must comply in all respects with the University’s acceptable use policy.
Linking from our site
Where the University’s site contains links to other sites or resources provided by third parties, these links are provided for your information only. We accept no responsibility for them or for any loss or damage that may arise from your use of them. We are not responsible for examining or evaluating. We do not assume any responsibility or liability for the actions, products, and content of any of linked site or any other third-party.
Additional Chargeable Aluminati Services
Some services may be available for purchase or upgrade. Prices shall be as published within the site. Prices and services may change from time to time. Changes will be posted on the site and billing systems. Such changes will not affect any then-current subscriptions or paid-for services but will apply when membership is due for renewal or a further service is purchased.
Payments are to be made net of any bank charges: the amount transferred, after any such deductions, must equal the amount due from you to Aluminati.
Our liability
Material posted on the University’s site, including material posted by Aluminati, is not intended and must not assume to amount to advice on which reliance may be placed.
University Material is provided on an 'AS IS' and 'AS AVAILABLE' basis. To the extent permitted by law, the University excludes any representations or any warranties (whether express or implied by law), including as to satisfactory quality, fitness of a particular purpose, non-infringement, compatibility, security, accuracy or the reliability of the site.
Nothing in these terms of use is intended to exclude the University's liability for death or personal injury caused by the University's proven negligence or fraudulent misrepresentation or any other liability which cannot be excluded or limited by law. Subject to that, neither the University nor Aluminati will be liable to you or any party for any of the following losses or damage even if the losses were reasonably foreseeable to both you and us when you began using the site: loss of data, loss of revenue or anticipated profits, loss of business, loss of opportunity, loss of goodwill or injury to reputation, loss suffered by third parties, any direct, indirect, special, incidental, or consequential loss or damages arising out of use of the site or reliance on any material or services provided in the site or accessed through it, whether or not amended by third parties and regardless of form of action and whether or not resulting from either of us breaching these conditions or from disruption, discontinuation or unavailability of the site at any time.
Trade marks
The name and shield of the University of Cambridge are trade marks.
Jurisdiction
You agree, as we do, to submit to the exclusive jurisdiction of the English courts except that either or both the University and Aluminati may bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.
General
If you breach these conditions and we take no action, we will still be entitled to use our respective rights and remedies in any other situation where you breach these conditions.
The headings in these conditions are for ease of reference only. Words preceding "include", "includes", "including" and "included" shall be construed without limitation by the words which follow those words. Definitions apply to any word derived from a defined word. Nothing in these conditions is intended to nor shall they confer any benefit on any third party whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise. If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
